These General Terms and Conditions of Sale and Service govern access to and use of the services offered on the websites www.barcorallo.com and www.damonicacapri.com, as well as product sales and reservations made under the Da Monica and Bar Corallo brands.

2. NATURE OF PRODUCTS AND SERVICES
The user acknowledges that the Controller operates in the catering and artisanal pastry sector.
• Artisanship: Products are handmade; slight aesthetic differences compared to photographic images, which are for illustrative purposes only, are to be considered proof of the artisanal nature of the product.
• Allergens: Pursuant to EU Regulation 1169/2011, information on substances causing allergies or intolerances is available by consulting the appropriate documentation at the premises or by contacting the Controller before purchase. It is the user's responsibility to report severe allergies during the ordering or reservation phase.
3. TABLE RESERVATIONS AND RESTAURANT SERVICE
• Confirmation: The reservation is considered confirmed only upon receipt of the confirmation email or SMS.
• Delay and No-Show: A tolerance time of 15 minutes is provided. After this term, the Controller reserves the right to release the table.
• Guarantee: For large groups or special dates, a credit card may be requested as a guarantee. In case of a no-show without cancellation within the previous [e.g., 12/24 hours], a penalty of [e.g., EUR 20.00] per person may be applied.
4. ONLINE PURCHASES, PAYMENTS, AND SHIPPING
• Conclusion of the Contract: The order is intended as accepted only at the time of successful payment through the integrated platforms (Stripe/PayPal/Nexi).
• Pastry Shipping: The Controller guarantees the integrity of the product until delivery to the carrier. The Controller is not responsible for delays caused by the courier or events of force majeure. For fresh products, shipping is limited to areas that guarantee respect for the cold chain or the fragility of the product.
• Failed Delivery: In case of the recipient's absence, as these are perishable goods, the Controller is not responsible for any deterioration of the product due to storage at the courier's premises.
5. EXCLUSION OF THE RIGHT OF WITHDRAWAL
Pursuant to Art. 59, letters d) and e) of the Italian Consumer Code (Legislative Decree 206/2005), the right of withdrawal is EXCLUDED for:
1. The supply of goods that are likely to deteriorate or expire rapidly (cakes, fresh pastries, rotisserie products, ready meals).
2. The supply of sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery.
For non-perishable products (e.g., merchandise or sealed packages of dry biscuits), withdrawal can be exercised within 14 days of receipt, with shipping costs borne by the customer.
6. LIMITATION OF LIABILITY
The Controller shall not be liable for indirect damages, loss of data, or service interruptions due to technical problems of the hosting provider (Vercel) or payment gateways.
7. INTELLECTUAL PROPERTY
All content, including texts, logos, and photos of dishes, is the exclusive property of the Da Monica and Bar Corallo brands. Unauthorized reproduction is prohibited.
8. APPLICABLE LAW AND JURISDICTION
This Contract is governed by Italian law. Any dispute relating to its validity, interpretation, or execution shall be submitted to the exclusive jurisdiction of the Court of Naples (Napoli), without prejudice to the mandatory forum of the consumer where applicable.
